1 week after the coming of Modi govt., on June 2, 2014, while he was returning after offering namaz, a mob of Hindu Rashtra Sena (HRS) workers allegedly lynched him to death.
A young Muslim man was killed & in spite of facing community pressure, to enforce laws, local police, law enforcement officials refused or were unable to enforce state or federal laws.
At the time, morphed pictures of Shivaji Maharaj and Bal Thackeray had gone viral on Facebook. Outraged, members of the Hindu Rashtra Sena allegedly went on a rampage, vandalizing cars and buses. A few of them allegedly cornered Mohsin and thrashed him with hockey sticks. For an hour, no bystander intervened or helped the bloodied Mohsin. His roommate called Mubin, who took Mohsin to the hospital. Mohsin was declared dead the same night.
21 men were accused in Mohsin’s murder case including Hindu Rashtra Sena (HRS) chief Dhananjay Desai.
In October 2014, the government in Maharashtra changed. BJP came to power with the support of Shiv Sena. The state’s famous public prosecutor Ujjwal Nikam was handling the case then. But he recused himself from the case. The lawyer’s decision came as a shock to Shaikh’s family, as well as their supporters and sympathizers who were fighting for justice. After years of fighting for justice for his son Mohsin, Sadiq Shaikh contracted blood pressure. He passed away in 2018. Mohsin’s mother contracted diabetes. The sole bread-winner of the family, Mubin, is still trying to get a government job. He struggles to buy medicines for his mother and continues to await justice for his brother.
Until 6 May 2017, the case was still in the stage of framing of charges against all the 21 accused, without a public prosecutor. Dhananjay Desai was granted bail on 17 January 2019. All other accused, too, have been granted bail. Mohsin’s family continues to wait for justice.
Mohsin’s murder isn’t just yet another failure of the Indian state in safeguarding the lives and properties of its Muslim minority. It is also the failure of the political imaginations of Muslims in India. Mohsin was murdered on 2nd June 2014. Shaheen Bagh should have started on 3rd June 2014. Shaheen Bagh was too little and too late.
